    Terms of Service

    Welcome to Synth (synth.net.au). By creating an account or using the platform you agree to these Terms of Service. If you do not agree, do not use Synth.

    1. User Eligibility

    You must be at least 16 years of age to create an account. By registering you represent that you meet this requirement. Synth reserves the right to suspend or terminate accounts that violate this condition.

    2. Intellectual Property & Content Ownership

    When you upload, publish, or list code on Synth you represent and warrant that you are the original author or hold all necessary rights, licences, and permissions to distribute that content. You retain ownership of your code. By listing it for sale you grant Synth a non-exclusive licence to host and display the content as needed to operate the marketplace.

    3. Digital Kit Purchases & Refund Policy

    All purchases of app kits, code files, and digital assets on Synth are final. Due to the digital and instantly-deliverable nature of code, no refunds will be issued once a purchase is complete. Please review all available information (description, previews, stack details, reviews) before purchasing.

    3a. Custom Services (Upgrade Packs & Commissions)

    Synth offers optional upgrade packs — fixed-scope add-on services attached to a kit purchase. Each pack has defined deliverables, a maximum number of revisions, and an estimated delivery window.

    • Scope: Only work listed in the accepted checklist (produced during intake and confirmed by the builder) is included. Requests outside the checklist require a separate pack purchase.
    • Quotes: Estimates generated during the AI-assisted intake are non-binding. The builder confirms or revises pricing before work begins.
    • Bits deposits: A Bits deposit may be held when a commission is created. Deposits are refunded if the commission is rejected by the builder and consumed on acceptance.
    • AUD payments: Where an upgrade pack requires AUD payment, the builder will provide a Stripe payment link. Payment is made directly to the builder or platform via Stripe.
    • Completion: “Done” means every item on the accepted checklist is delivered. Subjective satisfaction beyond the checklist is not grounds for a refund.

    3b. AI-Assisted Intake (Synth Assist)

    Synth Assist is an AI tool that helps buyers structure customisation requests into checklists. It does not independently promise deliverables, set binding prices, or approve scope. A human builder reviews every brief before work begins.

    Intake conversations may be logged for fulfilment purposes. Do not share sensitive credentials, API keys, or personal data in intake chats. Synth is not responsible for secrets shared in conversations.

    4. Content Moderation

    Synth reserves the right to review, modify, or remove any content at any time and for any reason, including but not limited to content that violates these Terms, infringes third-party rights, contains malicious code, or is otherwise objectionable. We may also suspend or terminate your account at our discretion.

    5. Acceptable Use

    • Do not upload malware, backdoors, or deliberately harmful code.
    • Do not misrepresent the authorship or functionality of content.
    • Do not attempt to circumvent platform fees or payment mechanisms.
    • Do not harass, abuse, or threaten other users.
    • Do not use automated tools to scrape or reproduce marketplace content.

    6. Limitation of Liability

    Synth is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Synth and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the platform, including loss of profits, data, or business opportunities.

    We do not guarantee that code purchased through the marketplace will be free of errors, fit for a particular purpose, or compatible with your environment.

    7. Indemnification

    You agree to indemnify and hold harmless Synth, its operators, employees, and affiliates from any claims, damages, or expenses arising from your use of the platform or your violation of these Terms.

    8. Changes to These Terms

    We may update these Terms from time to time. When we do, the “Last updated” date above will be revised. Continued use of Synth after changes constitutes acceptance of the updated Terms.

    9. Governing Law

    These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
